The new critical edition of the works and correspondence of Jeremy Bentham is being prepared and published under the supervision of the Bentham Committee of University College London. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, and (...) three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. The overall plan and principles of the edition are set out in the General Preface to The Correspondence of Jeremy Bentham, vol. 1, which was the first volume of the Collected Works to be published.An Introduction to the Principles of Morals and Legislation, Jeremy Bentham's best-known work, is a classic text in modern philosophy and jurisprudence. In this reply to Tim Bayne and Yujin Nagasawa, I defend the possibility of a maximal-excellence account of the grounding of the obligation to worship God. I do not offer my own account of the obligation to worship God; rather I argue that the major criticism fails. Thus maximal-excellence can ground an obligation to worship God.

The contractarian theory elaborated by John Rawls in A Theory of Justice exploits the difference principle in a great many ways. Rawls argues that, when used as part of a set of guiding principles for structuring the basic institutions of society, it simplifies the problem of interpersonal comparisons (91-4)1, helps compensate for the arbitrariness of natural endowments (101-3), promotes a harmony of interests between citizens (104-5), reintroduces the principle of fraternity to democratic society (105-6), and, what is critical to his (...) contractarian theory, it is an essential part of the principles of justice which would be chosen by free, equal, and rational persons in the original position. The first five volumes of the Correspondence of Jeremy Bentham contain over 1,300 letters written both to and from Bentham over a 50-year period, beginning in 1752 (aged three) with his earliest surviving letter to his grandmother, and ending in 1797 with correspondence concerning his attempts to set up a national scheme for the provision of poor relief. Against the background of the debates on the American Revolution of 1776 and the French Revolution of 1789, to which he made (...) significant contributions, Bentham worked first on producing a complete penal code, which involved him in detailed explorations of fundamental legal ideas, and then on his panopticon prison scheme. Despite developing a host of original and ground-breaking ideas, contained in a mass of manuscripts, he published little during these years, and remained, at the close of this period, a relatively obscure individual. Nevertheless, these volumes reveal how the foundations were laid for the remarkable rise of Benthamite utilitarianism in the early nineteenth century. Bentham’s early life is marked by his extraordinary precociousness, but also family tragedy: by the age of 10 he had lost five infant siblings and his mother. The letters in this volume document his difficult relationship with his father and his increasing attachment to his surviving younger brother Samuel, his education, his interest in chemistry and botany, and his committing himself to a life of philosophy and legal reform. The writings collected in this volume make an important addition to The Collected Works of Jeremy Bentham. They lend credence to Bentham's claim that his ideas were appropriate `for the use of all nations and all governments professing liberal opinions'. The essays, dating mainly from late 1822 and early 1823, are based exclusively on manuscripts, many of which have not been previously published. -/- Turning his attention towards the Mediterranean basin, Bentham here attempts to legislate for one Islamic state, (...) and offers advice to another in the process of throwing off Islamic rule. The Writings for Tripoli include the famous `Securities against Misrule', in which Bentham draws up a constitutional charter with an accompanying explanation of its provisions. He also discusses the social, political, and religious institutions of the country, and proposes a scheme for the introduction of constitutional reform both there and in the other Barbary states. The Writings for Greece include a rare commentary on the first Greek constitution of 1822, and advice and warnings to the Greek legislators against the temptation of `sinister appetites'. The main theme in both groups of writings is the efficacy of representative institutions and the publicity of official actions in preventing the abuse of government power. (shrink)

The essays which Bentham collected together for publication in 1830 under the title of Official Aptitude Maximized; Expense Minimized, written at various times between 1810 and 1830, deal with the means of achieving efficient and economical government. In considering a wide range of themes in the fields of constitutional law, public finance, and legal reform, Bentham places the problem of official corruption at the centre of his analysis. He contrasts his own recommendations for good administration, which he had fully developed (...) in his magisterial Constitutional Code, with the severe deficiencies he saw in English practice. The core of the volume consists of four major essays directed against the principles and policies of four leading statesmen: Edmund Burke, George Rose, Robert Peel, and Lord Chancellor Eldon. Of particular concern to Bentham were the abuses sanctioned by the judges and their officials in the Westminster Hall courts, which, he argues, resulted in the denial of justice to the majority of the population. In this volume, Bentham not only displays the precise logical reasoning for which he is well known, but also his considerable skills as a rhetorician of reform. (shrink)

Political Tactics, composed for the Estates General just before the French Revolution, is one of Bentham's most original works. It contains the earliest and perhaps most important theoretical analysis of parliamentary procedure ever written. Bentham's best-known book stands as a classic of both philosophy and jurisprudence. Evidentialism is the thesis that epistemic justification for belief supervenes on evidential support. However, we claim there are cases in which, even though two subjects have the same evidential support for a proposition, only one of them is justified. What make the difference are pragmatic factors, factors having to do with our cares and concerns. Our argument against evidentialism is not based on intuitions about particular cases. Rather, we aim to provide a theoretical basis for rejecting evidentialism by defending a (...) “pragmatic” necessary condition on epistemic justification. We argue for the following necessary condition for justification: S is justified in believing that p only if S is rational to prefer (and, hence, act) as if p. In light of this necessary condition, the price of evidentialism is skepticism, or something close to it. (shrink)

Early to mid-nineteenth-century America experienced a cultural fascination with oneness or monism--the notion that individuals are not separate from divinity but, rather, that the individual soul is an incarnation of the universal soul. Everything is one. This buzz of monism was traceable in part to translations of the Vedas by Indian philosopher Rammohun Roy and found some of its fullest expression in the work of Ralph Waldo Emerson and Walt Whitman. This oneness tradition is what animates Jeremy David Engels--not (...) only because we can't understand Emerson, Whitman, and other American philosophers without it, but because Engels thinks this tradition offers a way of thinking and acting that can meet the ethical challenges of everyday democracy in the present. The Ethics of Oneness is not only a brilliant study of the centrality of the Bhagavad Gita in the philosophy of Emerson and Whitman and a compelling reception history of the Gita in America, it is also a constructive project of moral and political philosophy intended to open possibilities for the present. If the lessons of oneness are taken to heart, Engels thinks, it ispossible to counter the pervasive, problematic American ideals of separation, competition, hierarchy, exclusion, and domination. For both Emerson and Whitman, American democracy requires a firm ontological foundation of oneness that is beyond question if it is to survive and thrive. (shrink)

In this paper, we offer a brief, critical survey of contemporary work on truth. We begin by reflecting on the distinction between substantivist and deflationary truth theories. We then turn to three new kinds of truth theory—Kevin Scharp's replacement theory, John MacFarlane's relativism, and the alethic pluralism pioneered by Michael Lynch and Crispin Wright. We argue that despite their considerable differences, these theories exhibit a common "pluralizing tendency" with respect to truth. In the final section, we look at the underinvestigated (...) interface between metaphysical and formal truth theories, pointing to several promising questions that arise here. (shrink)

Si Bentham, en effet, a consacré l'essentiel de ses travaux à des projets de réforme de la société anglaise de son temps par le biais de la codification des lois, il n'a cessé d'enrichir cette réflexion par des emprunts faits à d'autres disciplines, dans lesquelles il était également passé maître, telles la morale, la (...) psychologie, la logique, la théorie du langage, l'économie ou la politique. Cette pensée, à la fois plurielle et ambiguë (est-elle conservatrice, réformiste, révolutionnaire ou utopique? est-elle descriptive, explicative ou normative?), révèle aujourd'hui son étonnante actualité. Il est peu de thèmes juridiques contemporains qui ne trouvent en effet leur place dans l'œuvre de Bentham : ainsi les questions de l'utilité, de la balance des intérêts, de la constitution d'une science du droit et d'une logique déontique; ainsi les concepts de système juridique, de codification, de déontologie, de contrôle social, d'opinion publique et de majorité politique. L'intérêt de cette " relecture " de la pensée de Bentham réside dès lors sans doute moins dans l'exégèse de ses multiples détours que dans la mise en lumière de ses ambiguïtés et de ses limites qui, pour une large part, sont aussi les nôtres. This paper presents a new argument for necessitism, the claim that necessarily everything is necessarily something. The argument appeals to principles about the metaphysics of quantification and predication which are best seen as constraints on reality’s fineness of grain. I give this argument in section 4; the impatient reader may skip directly there. Sections 1-3 set the stage by surveying three other arguments for necessitism. I argue that none of them are persuasive, but I think it is illuminating to consider (...) my argument in light of the others and vice versa. These interconnections should be of interest even to those who reject necessitism; of particular interest may be the new conception of validity proposed in section 5. (shrink)

Many contemporary proponents of hylomorphism, the view that at least some material objects are comprised of both matter and form, endorse a version of hylomorphism according to which the form of a material object is a certain complex relation or structure. In this paper, I introduce three sorts of concerns for this “structural” approach. First, I argue that, in countenancing an abundance of overlapping yet numerically distinct material objects, “structural hylomorphists” are committed to a certain sort of systematic causal overdetermination. (...) Second, I argue that, because of its relatively thin conception of form, the view risks collapsing into some already well-entrenched metaphysical account of material objects. Finally, I argue that because the view emphasizes the more static structural features of composite material objects, structural hylomorphists seem unable to explain how it is that those objects might be said to persist over time through changes in such features. Recent defenders of the divine command theory like Adams and Alston have confronted the Euthyphro dilemma by arguing that although God’s commands make right actions right, God is morally perfect and hence would never issue unjust or immoral commandments. On their view, God’s nature is the standard of moral goodness, and God’s commands are the source of all obligation. I argue that this view of divine goodness fails because it strips God’s nature of any features that would make His goodness (...) intelligible. An adequate solution to the Euthyphro dilemma may require that God be constrained by a standard of goodness that is external to Himself -- itself a problematic proposal for many theists. (shrink)

D’un point de vue de psychologue exerçant en oncologie pédiatrique, il s’agit ici d’éclairer les enjeux psychiques liés à l’irruption d’un cancer chez l’enfant en portant une attention particulière sur la manière dont cet événement éprouvant est vécu par ses parents et dont on peut en retrouver les effets dans le discours de l’enfant. La possibilité pour l’enfant de dire ce qu’il perçoit dans le regard meurtri de ses parents porté sur lui nous semble contribuer à l’appropriation de l’épreuve de la maladie, voire au dépassement de celle-ci. It is now more than ten years since the EU FET project ALFEBIITE finished, during which its researchers made original and distinctive contributions to (inter alia) formal models of trust, model-checking, and action logics. ALFEBIITE was also a highly inter-disciplinary project, with partners from computer science, philosophy, cognitive science and law. In this paper, we reflect on the interaction between computer scientists and information and IT lawyers on the idea of the ‘open agent society’. This inspired a programme of research (...) whose investigation into conceptual challenges has carried it from the logical specification of agent societies and dynamic norm-governed systems to self-organising electronic institutions, while developing several technologies for agent-based modelling and complex event recognition. The outcomes of this inter-disciplinary collaboration have also influenced current research into using the open agent society as a platform for socio-technical systems, and other collective adaptive systems. We present a number of research challenges, including the ideas of computational justice and polycentric governance, and explore a number of ethical, legal and social implications. We contend that, in order to address these issues and challenges, the continued inter-disciplinary collaboration between computer science and IT lawyers is critical. (shrink)

Colonies, Commerce, and Constitutional Law is a major theoretical analysis of the harmful effects of colonies on commerce and constitiutional democracy, and is one of the most important studies of colonialism written in the nineteenth century. Of the four essays collected in this voloume, three have been edited directly from the original manuscript sources. The only essay to have appeared in print, `Observations on the Restrictive and Prohibitory Commercial System', is generally regarded as an early classic statement of the beneficial (...) effects of freedom of trade. In the these pioneering essays written in 1820-2, Bentham provided a penetrating critique of colonialism from within the liberal utilitarian tradition. Applying his general principles to the case of Spain and Spanish America, he argued that any attempt by Spain to maintain dominion over her Empire, or even to maintain a claim to the dominion was fundamentally misguided. Colonies were not a source of wealth to the colonizing country, but rather led to the imposition of increased taxation. Moreover, the existence of colonies increased the amount of patronage at the disposal of Spain's rulers, and thus would facilitate the corruption of the members of the new legislative assembly and eventually lead to the restoration of the ancient despotism. Colonies were not only wasteful and expensive, but posed a threat to constitutional government itself. The should therefore be granted unconditional independence, as a prererequisite to the establishment of unrestricted commercial relations, which would produce mutual benefit to both Spain and Spanish Amarica. These letters - the vast majority of which have never been published before - illustrate many aspects of Bentham's public and private life. The composition, editing, printing, publishing, and reception of several of his writings are discussed, while the correspondence with his secretary and protégé John Herbert Koe gives a unique insight into Bentham's working methods. The proposed Chrestomathic School is the subject of many of the letters of 1820, though even in that year Bentham's involvement in the world of (...) radical politics emerges clearly. Bentham's central concern during the 1810s and 1820s was with the codification of the law. Rejecting both the common law and the historical approach to codification, he argued that a code of law should be based on a rigorous logical analysis of the categories of human action, and that each enactment should be followed by the reasons which justified it. Such an `all-comprehensive' code containing an `interwoven rationale' would signal a new era in legislation. Once one state had adopted such (...) a code, other states would be obliged to follow its example, and Bentham would become in effect 'legislator of the world'. Bentham attempted to persuade legislative authorities in the United States of America, Russia, Spain, Portugal, Greece, South and Central America, and elsewhere, to invite him to draft a code of law for them. The works presented in this volume record in fascinating detail Bentham's dealings with such eminent figures as James Madison, John Quincy Adams, Emperor Alexander I, Prince Adam Czartoryski, Alexander Mavrokordatos, Bernadino Rivadavia, and José del Valle. The production of a methodology for codification ranks as one of Bentham's outstanding theoretical achievements. Through the materials presented in this volume he emerges as a seminal figure in the development of liberalism throughout Europe and America in the early nineteenth century. (shrink)

When should you engage with difficult arguments against your cherished controversial beliefs? The primary conclusion of this book is that your obligations to engage with counterarguments are more limited than is often thought. In some standard situations, you shouldn't engage with difficult counterarguments and, if you do, you shouldn't engage with them open-mindedly. This conclusion runs counter to aspects of the Millian political tradition and political liberalism, as well as what people working in informal logic tend to say about argumentation. (...) -/- Not all misleading arguments wear their flaws on their sleeve. Each step of a misleading argument might seem compelling and you might not be able to figure out what's wrong with it. Still, even if you can't figure out what's wrong with an argument, you can know that it's misleading. One way to know that an argument is misleading is, counterintuitively, to lack expertise in the methods and evidence-types employed by the argument. When you know that a counterargument is misleading, you shouldn't engage with it open-mindedly and sometimes shouldn't engage with it at all. You shouldn't engage open-mindedly because you shouldn't be willing to reduce your confidence in response to arguments you know are misleading. And you sometimes shouldn't engage closed-mindedly, because to do so can be manipulative or ineffective. -/- In making this case, Jeremy Fantl discusses echo chambers and group polarization, the importance in academic writing of a sympathetic case for the opposition, the epistemology of disagreement, the account of open-mindedness, and invitations to problematic academic speakers. We use a deep embedding of the display calculus for relation algebras ÆRA in the logical framework Isabelle /HOL to formalise a machine-checked proof of cut-admissibility for ÆRA. Unlike other “implementations”, we explicitly formalise the structural induction in Isabelle /HOL and believe this to be the first full formalisation of cutadmissibility in the presence of explicit structural rules.

Abstract We begin by asking what fallibilism about knowledge is, distinguishing several conceptions of fallibilism and giving reason to accept what we call strong epistemic fallibilism, the view that one can know that something is the case even if there remains an epistemic chance, for one, that it is not the case. The task of the paper, then, concerns how best to defend this sort of fallibilism from the objection that it is ‘‘mad,’’ that it licenses absurd claims such as (...) ‘‘I know that p but there’s a chance that not p’’ and ‘‘p but it there’s a chance that not p.’’ We argue that the best defense of fallibilism against this objection—a ‘‘pragmatist’’ defense—makes the following claims. First, while knowledge that p is compatible with an epistemic chance that not-p, it is compatible only with an insignificant such chance. The focus of this essay is Paul de Man's provocative antipathy towards the category of the aesthetic in his late writings on philosophical aesthetics. I introduce de Man's critique of what he terms aesthetic ideology – a form of ideological communication – which he considers manifest in the aesthetics of Schiller in particular but also in more scrupulously critical philosophers. I begin the essay with Benjamin's well known observation that twentieth century fascisms aestheticized political practice as part of a defence (...) of existing property relations. I introduce de Man's critique of aesthetic ideology as a way of developing or elaborating on what are relatively sketchy comments on the relationship aesthetics and politics in Benjamin's earlier essay. 0n a lucid, concise volume, Jeremy Waldron defends the role of legislation, presenting it as an important mode of governance. A rarely examined internal reading by Bourdieu at the end of The Rules of Art of William Faulkner's short story ‘A Rose for Emily’ provides the starting point for a reflection on Bourdieu's theories of reading and reflexivity. The article begins by looking at Bourdieu's theory of literary reception, and its identification of two distinct modalities of reading, ‘scholastic’ and ‘naive’. It then places Bourdieu's discussion of ‘A Rose for Emily’ as a ‘reflexive’ text in the context of his wider (...) theory of reflexivity. Bourdieu's approach to reading Faulkner's text is compared with those deployed elsewhere by more established literary critics, notably Jean-Paul Sartre and Roland Barthes. Finally, the question of how his internal reading fits within the logic of a theoretical work devoted to the ‘reflexive’ practice and method of field analysis is discussed. (shrink)

The Panopticon project for a model prison obsessed the English philosopher Jeremy Bentham for almost 20 years. In the end, the project came to nothing; the Panopticon was never built. But it is precisely this that makes the Panopticon project the best exemplification of Bentham’s own theory of fictions, according to which non-existent fictitious entities can have all too real effects. There is probably no building that has stirred more philosophical controversy than Bentham’s Panopticon. The Panopticon is not merely, (...) as Foucault thought, “a cruel, ingenious cage”, in which subjects collaborate in their own subjection, but much more—constructing the Panopticon produces not only a prison, but also a god within it. The Panopticon is a machine which on assembly is already inhabited by a ghost. It is through the Panopticon and the closely related theory of fictions that Bentham has made his greatest impact on modern thought; above all, on the theory of power. The Panopticon writings are frequently cited, rarely read. This edition contains the complete “Panopticon Letters”, together with selections from “Panopticon Postscript I” and “Fragment on Ontology”, Bentham’s fullest account of fictions. I compare deterministic and stochastic hidden variable models of the Bell experiment, exphasising philosophical distinctions between the various ways of combining conditionals and probabilities. I make four main claims. (1) Under natural assumptions, locality as it occurs in these models is equivalent to causal independence, as analysed (in the spirit of Lewis) in terms of probabilities and conditionals. (2) Stochastic models are indeed more general than deterministic ones. (3) For factorizable stochastic models, relativity's lack of superluminal causation does not favour (...) locality over completeness. (4) If we prohibit all superluminal causation, then the violation of the Bell inequality teaches us a lesson, besides quantum mechanics' familiar ones that quantities can lack precise values and that pairs of quantities can lack joint probabilities: namely, some pairs of events are not screened off by their common past. Ballantyne correctly notes the need for clarification as to the standard of fairness that should guide nonexploitative international research on human subjects. When accounts of exploitation are applied to pharmaceutical development (as well as other areas), there is too often an uncritical acceptance that exploitation involves a form of unfairness. Moreover, these authors typically fail to produce an account of fairness by which exploitation should be identified. Ballantyne should be applauded for her attempt to inject greater clarity into these debates. (...) Her preferred standard of fairness is problematic, however. Ballantyne fails to distinguish between at least two forms of exploitation, tied to two distinct forms of unfairness, that can take place in international research on human subjects. As I argue here, the first form of exploitation derives from transactional unfairness where researchers take special unfair advantage of research subjects. The second form of exploitation occurs when researchers take advantage of background injustices that disadvantage research subjects. As a result of this failure to differentiate between different forms of exploitation, Ballantyne misidentifies the requirements of fairness for engaging in nonexploitative international human subject research. Without either of them, there would not be a drift; there is no drifting without the drifter. Both the drifter and the drifting are in a relationality; in which, all that they can know is that they are in relation with each other. Hence, the drift itself is a relationality. A non-essence. But, it is not as if we cannot speak of it. Perhaps though: we can only speak of it as if we can speak of it. Always already an imaginary gesture; where what is being imagined is the relationality between the drift and the ones drifting. Thus, we have a situation where the drifter and drifting are in a relationality; where relationality itself is what is being imagined. Perhaps then, what are we drifting from, to? , is a moot question. As is, what is drifting? Perhaps then, all we can say is drift? To speak of drift is an attempt to speak of the unspeakable. Not that what is speakable and what is unspeakable are antonyms: if that were so, speaking the unspeakable would make no sense, be a contradiction. But that in every act of speaking, something unspeakable is potentially said: something that opens, ruptures, wounds even. And not just that—at the point where it punctures, speaking itself moves out of the way for the unspeakable; speaking itself disappears. "… the whole art is to know how to disappear before dying, and instead of dying. " 2 To disappear; or, to drift out of sight. Where the words themselves slip away. After all: "in the Beginning was the Word. It was only afterwards that Silence came." And here, we should not forget Lucretius' lesson that communication occurs in the skin between the parties in communion with each other. Which is not to say that the encounter is determined by atoms—and more precisely atoms that move in straight lines until they collide with each other—that communication is pre-determined. For, one must not forget that will is found, discovered, enacted even, at the moment the atoms swerve. Clinamen . Drift. But even in their movement—drifting—they trace themselves into the skin between; a tangential touching. Perhaps only briefly. But even then, enough … "… there's always texture that betrays the place." (May Ee Wong) Here though, one must not forget that betrayal cannot happen in the absence of love. In fact, betrayal is the very excess of love: where one loves the other so much that one can no longer bear to see the other drift from what (s)he could have been. Whether that idealised other exists or is only in one's head is another question altogether. Perhaps, a fetishised other: keeping in mind that "fetishes are hinged around simulation." After all, "when one is supposed to show up as an oil rig diver no one is expecting actual crude oil" (Amanda Sordes); in fact, actualisation is the perfect way to destroy the fantasy. Perhaps then, the only way to maintain love for another is to maintain a proper distance, as it were, from love: allow the love to constantly alter, change. And here, one must not forget that if love is a relationality between one and another who remains wholly other (otherwise just a mere manifestation of the self), love is a relationality that knows nothing except for the fact that it is in a relation. For, to love one has to attend to—without subsuming another, some other, under oneself. Which means that to love, one has to be willing to risk, to open oneself, to allow oneself to be wounded, torn apart. In new ways, ways that we have yet to understand, come across, ways we do not yet have a name for. Thus, this movement in love is one that occurs in utter blindness; to not only the other, but to what love is. This is love as pure drifting. Perhaps always searching for love itself, without ever knowing what it is that it is looking for. Love: only at the very moment when the word love itself disappears. Perhaps all we can do is sit, and attend: watching the tides flowing away—as if they were having their "last swim of the summer." The present volume is one of a type we should soon expect to be seeing more of in philosophy of medicine. Philosophy of medicine has now been around long enough that entire careers, or at least substantial portions of careers, can and have been devoted to it. This is an important milestone in the field.This is true, even though, as the author indicates in the introduction, this is not solely a book of philosophy of medicine. Investigations in philosophy of medicine, (...) and the essays included in this volume in particular, can not only contribute to “the development of philosophy of medicine as a discipline” but can also “test and help revise some of [philosophy of science’s] views” . Thus, this book is intended as a contribution both to philosophy of medicine as a specific discipline and to philosophy of science generally. This paper forms part of a wider campaign: to deny pointillisme, the doctrine that a physical theory's fundamental quantities are defined at points of space or of spacetime, and represent intrinsic properties of such points or point-sized objects located there; so that properties of spatial or spatiotemporal regions and their material contents are determined by the point-by-point facts. More specifically, this paper argues against pointillisme about the concept of velocity in classical mechanics; especially against proposals by Tooley, Robinson and Lewis. (...) A companion paper argues against pointillisme about -geometry, as proposed by Bricker. To avoid technicalities, I conduct the argument almost entirely in the context of "Newtonian" ideas about space and time, and the classical mechanics of point-particles, i.e. extensionless particles moving in a void.
